These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "your") and Texas Pride Painting LLC, a Texas limited liability company ("Texas Pride Painting," "Company," "we," "us," or "our"), regarding your access to and use of texaspridepaintingllc.com (the "Website") and any painting services, communications, or related products we provide (collectively, the "Services").

By accessing or using the Website, submitting a contact form, engaging our services, or receiving communications from us, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Website or our Services.

When you request a free estimate through our Website or by phone, you are under no obligation to hire Texas Pride Painting LLC. Estimates are provided at no cost and are valid for 30 days unless otherwise stated. Final pricing may vary based on on-site assessment and actual project scope.

• We reserve the right to withdraw or revise an estimate if information provided at the time of estimate is inaccurate or incomplete.
• Final pricing may increase if conditions discovered during work require additional labor or materials (for example, extensive repair, additional coats to cover existing colors, surface preparation beyond the original scope, or hidden damage).

6. Our Services

Texas Pride Painting LLC provides residential and commercial painting services in the Austin, Texas area. Services may include (without limitation):

• Interior painting
• Exterior painting
• Cabinet painting and refinishing
• Deck and fence staining / painting
• Drywall repair and prep work
• Pressure washing preparation
• Commercial painting

All services are performed in accordance with industry standards and applicable Texas regulations. We carry general liability insurance for our painting operations in the State of Texas. Proof of insurance is available upon request.

Service agreement:

All painting services are subject to a separate written service agreement provided before work begins. That agreement will detail:

• Scope of work and surfaces to be painted
• Paint brands, colors, sheens, and finishes selected
• Surface preparation and priming requirements
• Project schedule and expected duration
• Drying / cure times between coats
• Total cost and payment terms
• Warranty coverage (separate from the Website liability terms)
• Access, power, and ventilation requirements on the customer side

The service agreement is separate from these Terms. In the event of a conflict between these Terms and a signed service agreement, the service agreement controls for that specific project.

7. Customer Responsibilities

To help us deliver service safely and effectively, you agree that before and during service:

• You own or are authorized to request painting service for the property (for HOAs, you are responsible for obtaining required approvals before exterior color changes)
• You will provide safe access to the service area and reasonable access to water, power, and restrooms when needed
• You will remove or secure personal belongings, art, window treatments, electronics, and other items from the work area, unless otherwise agreed
• You will inform us of any pets, children, fragile items, plants, or sensitive surfaces requiring special care or avoidance
• You will keep pets and children away from the work area during painting and drying periods
• You will inform us of any pre-existing damage or defects (drywall cracks, water stains, rot, lead-based paint known to be present, etc.)
• For exterior work: you will inform us of sprinkler schedules and agree to shut them off during and after painting as directed

We are not responsible for damage caused by failure to follow these responsibilities or by pre-existing conditions not disclosed before work begins.

8. Satisfaction Guarantee

We stand behind our work. If you are not satisfied with any aspect of a completed service, contact us within 14 days of service completion and we will return to address the issue at no additional cost, subject to the following:

• The issue must be within the scope of the original service agreement
• You must provide reasonable access for re-service
• Re-service does not apply to damage caused by weather, ongoing property conditions, normal wear, or activities not under our control that occur after completion

This satisfaction guarantee is in addition to any warranty specified in your service agreement.

9. Warranty

Texas Pride Painting LLC provides a warranty on labor and materials as specified in your individual service agreement. Warranty terms vary by service type (interior, exterior, cabinets, staining, etc.) and are detailed in writing before work begins.

The warranty does NOT cover:

• Damage caused by neglect, abuse, or lack of maintenance
• Damage from acts of nature (hail, wind, flood, fire, freeze)
• Damage from unauthorized modifications or repairs by third parties
• Normal wear, fading, or color drift from sun exposure
• Damage to pre-existing surfaces or underlying substrate failures
• Peeling, blistering, or failure caused by moisture intrusion from unrelated sources (roof leaks, plumbing issues, poor drainage)

10. Contact Form and Communications

When you submit a contact form on our Website, call us, or email us:

• A team member will respond by email, phone, or text message (if you opted in for SMS) within normal business hours
• There is no obligation to purchase Services as a result of your inquiry
• Information you provide is handled according to our Privacy Policy

11. Payment and Cancellations

Payment terms are specified in your service agreement. Generally:

• Estimates are free
• A deposit may be required to schedule larger projects
• Payment is typically due upon completion of service, unless otherwise agreed
• Larger projects may have milestone payments (e.g., before start, mid-project, on completion)
• We accept cash, check, and major credit cards (processed through third-party payment processors)

Cancellations:

• You may cancel or reschedule a service appointment at least 48 hours before the scheduled start without charge
• Cancellations or reschedules requested with less than 48 hours notice may be subject to a rescheduling fee, plus any non-returnable materials already purchased
• We reserve the right to reschedule exterior painting due to weather, humidity, or temperature conditions outside paint manufacturer specifications; we will make reasonable efforts to notify you in advance

Disputed charges:

If you have a billing dispute, contact us at info@texaspridepaintingllc.com or (737) 340-5561 before initiating a chargeback. We will work to resolve the dispute in good faith.

12. SMS/Text Messaging Terms

By opting in to receive text messages from Texas Pride Painting LLC, you agree to the following:

Program Description: You may receive automated text messages from Texas Pride Painting LLC related to:

• Appointment reminders
• Project updates
• Promotional offers (if separately consented)
• Confirmation we received your inquiry
• Arrival time and technician status updates during active projects
• Paint drying / cure time reminders
• Follow-up quality check after service

Message Frequency: Message frequency varies. You may receive up to 4 messages per month.

Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. Texas Pride Painting LLC is not responsible for any charges incurred.

Opt-Out: You may opt out at any time by replying STOP to any message. After opting out, you will receive one final confirmation message and no further texts.

Consent Not Required: Your consent to receive text messages is not a condition of purchasing any goods or services from Texas Pride Painting LLC.

The Privacy Policy describes how we collect, use, share, and protect your information, including your rights under the Texas Data Privacy and Security Act (TDPSA), Global Privacy Control honoring, and SMS consent record keeping.

16. Disclaimers

The Website and its content are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim:

17. Limitation of Liability

18. Indemnification

You agree to defend, indemnify, and hold harmless Texas Pride Painting LLC, its owner, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees and expenses) arising from:

• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third party's rights, including intellectual property, privacy, or property rights (including HOA rules for exterior color changes)
• False or incomplete information you provided regarding your property or project

19. Dispute Resolution

Informal resolution:

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms, you agree to first contact us at info@texaspridepaintingllc.com or (737) 340-5561 and attempt to resolve the dispute informally. You agree to attempt informal resolution for at least thirty (30) days before initiating any formal legal proceeding.

Binding arbitration (optional consumer election):

If informal resolution does not succeed, you and we may (by mutual agreement) submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, its Supplementary Procedures for Consumer Related Disputes. Arbitration, if chosen, will take place in Travis County, Texas, unless the parties agree otherwise.

Exceptions to arbitration:

Either party may pursue the following in court without prior arbitration:

• Claims for injunctive relief
• Claims to enforce or protect intellectual property rights
• Claims in small claims court within its jurisdictional limit

Class action waiver:

You and we agree that any dispute will be brought on an individual basis only, not as a class action, collective action, or representative proceeding, to the fullest extent permitted by law.

20. Governing Law

These Terms and your use of the Website and Services are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction and venue of those courts. You agree that you will not bring any claim in any other jurisdiction.
